Terms, and other important points
Below are our Terms. Specific types of work have specific terms, with the exception of banner ads and jobs charged at an hourly rate all other jobs will be supplied a quotation which will detail specific points for the work to be undertaken. We like to be upfront about things, so included below are some of the terms you might find on your quotation. All of our work must comply with our General Business Terms unless arranged otherwise prior to starting the work.
Copyright of the all design materials produced remains the property of steelkey designs until full payment has been received, afterwhich the copyright will become the property of the Client. (With the exception of fine artwork to which copyright remains the property of Belinda Lindhardt and may not be reproduced in anyway without written permission.)
steelkey designs reserves the right to publish the work into the Agency portfolio online unless agreed to prior to work commencement.
Invoices are sent via email on the completion of your project.
Payment Terms
Our payment terms are 7days for hourly rate, banner packages and projects under $200-.
For all other projects we require 30% deposit prior to project commencement with the balance paid in installments defined at the time of quotation. (Usually at project milestones or time milestones).
We accept cheque or paypal but prefer direct deposit (details will be supplied on our invoice).
All content and text must be supplied in digital format i.e. via email, word or PDF document. Spell checking is ALWAYS the responsibility of the CLIENT.
It is assumed, that the copyright on all client supplied materials i.e. logos, images, text, photos is owned by the client and that copyright permission has been obtained for it's use.
Canceling design and/or development
Should the Client forfeit work after project commencement the deposit will be non-refundable regardless of the amount of work produced. Either party may terminate this agreement by giving 7 days notice in writing if the terms of engagement are breached. Should such notice be given, the amount to be paid to the Agency (steelkey designs) will be based on the amount of work performed at the date of termination.
Legal action will be persued for unpaid invoices. If there is unforeseen circumstances that arise which result in a delay in payment we will accept part payments but please discuss it with us and let us know what's going on.
As email is our main form of correspondence please note that email is considered written confirmation on design signoff, project commencement and approval to proceed on a project and requirements.
It is the Clients responsibility to ensure all requirements are outlined prior to project commencement.
Alterations and Changes to the specification or requirement work after project commencement MAY incur additional charges and must be agreed and confirmed by both parties. Any change requiring additional cost to the Client or resulting in a delay to the schedule will require approval by the steelkey designs and the Client in order to be included within the project.
Time Estimations
On supply of a quotation we will supply a time estimation for your project. We will do our utmost to ensure that our delivery is as per that schedule but sometimes things such public holidays, family illness, server problems, your design approval times and internal processes, delivery of materials may alter this figure. Please be aware of this constraint we will contact you should any problems arise that may cause significant delay.
Maintenance:
Our Graphics and HTML hourly rate is $66 per hour, billed in half hour blocks (yes if it only takes me up to 30mins thats ALL you pay for). Database and advanced programming is $88 per hour billed in hourly blocks. We can supply a reduced hourly rate depending on the amount of work you require and also can provide a maintenance / service agreement for a reduced set rate as well.
Our websites are tested in the latest versions of Internet Explorer and Firefox browsers on PC systems. The layout will be optimal in the latest version browsers but may not be fully functional or identical in layout in older version browsers.
Unless requirements are specifically stated in the quotation (prior to project commencement) functionality methods will be produced at our discretion.
Website developments do not commence until the following criteria are met:
the approval of tthe Quotation & Specification Document
supply of all reference materials (ie. photos, logo, text etc)
deposit is received
All of our websites come with a warranty which covers at our expense the fixing bugs or errors that may arise in our work. Warranty does not cover any alterations or additions to the work produced. Nor does it include rectifying work which has been altered by third party members or hosting/server problems.
Source Code (For database driven website, content management systems)
Steelkey designs retains the IP rights of all source code that it produces and reserves the right to have a copy of the code to re-use in part or whole for future developments, changes to this agreement must be arranged prior to work commencement and must be documented and signed by both parties. The Client retains a license to edit their souce code upon full payment of the project.

We are available for negotiation on illustration rates and can provide fixed cost at time of quotation.
Traditional illustration hourly rates are at $44- per hour and $55- for digital. "Rush jobs" for overnight and weekend work will be charged at a premium hourly rate.
